Terms of Use

These Terms of Use govern access to and use of the Wattiq platform, operated by Wattiq Tecnologia Ltda. (“Wattiq”, “we”), including the website, the app, the APIs and the artificial intelligence agents that make up the service.

By creating an account, subscribing to a plan or using any feature of the platform, you confirm that you have read, understood and agree to these Terms and to the Privacy Policy, which is an integral part of them.

If you use Wattiq on behalf of a company, you represent that you have the authority to bind it to these Terms — and references to “you” include that company. If you do not agree with any condition set out here, do not use the platform.

These Terms are governed by Brazilian law, in particular the Brazilian Internet Act (Marco Civil da Internet, Law No. 12,965/2014), the Civil Code and, where applicable, the Consumer Protection Code.

For ease of reading, the terms below have the following meaning when used in this document:

• Platform: the set of software, website, app, APIs and AI agents offered by Wattiq under the wattiq.com.br domain and its subdomains.
• AI Agents: the specialized autonomous assistants (Sales, Marketing and Procurement) that perform tasks such as prospecting, qualification, campaigns and content, system sizing and quoting.
• User: the individual who accesses the Platform and, where applicable, the company on whose behalf they act.
• Account: the individual registration that identifies the User and holds their settings, data and history.
• End Customer: the User’s customer or lead whose data is processed on the Platform — for example, consumers interested in solar energy.
• Plan: the subscription option chosen by the User, with the corresponding set of features, limits and price.

Wattiq is a complete solution for the Brazilian renewable energy industry — solar photovoltaics, the free energy market and storage (BESS) — made up of a management platform and a set of specialized AI agents:

• Sales Agent

  Prospects, qualifies and replies to leads, drafts proposals and schedules visits — including outside business hours.

• Marketing Manager

  Plans campaigns, produces content and tracks ads to generate qualified demand.

• Procurement Agent

  Requests quotes from distributors, compares kits and organizes the best purchasing conditions.

Available features depend on the Plan you subscribe to. The Platform evolves continuously: we may add, adjust or discontinue features, while preserving the core of the contracted service during the term of your Plan.

Integrations with third-party services (e.g. WhatsApp, social networks, advertising platforms, distributors) depend on the availability and rules of those third parties, which may change outside Wattiq’s control.

To use the Platform you must create an Account, providing true, complete and up-to-date information. By registering, you agree to:

• Keep your registration data up to date, including contact e-mail and phone number.
• Keep your access credentials confidential — the Account is personal and non-transferable.
• Notify Wattiq immediately in case of unauthorized use or suspected compromise of your Account.
• Be responsible for the activities carried out in your Account, including the actions configured in the AI Agents.

Wattiq may refuse, suspend or terminate registrations that violate these Terms, show signs of fraud or contain false information.

Plans are contracted through a commercial proposal, with prices, limits and conditions described at the time of contracting. Unless stated otherwise, amounts are charged on a recurring, prepaid basis.

• Late payment: overdue payment may lead to suspension of access after prior notice, in addition to the charges set out in the commercial proposal.
• Cancellation: you may cancel your Plan at any time; access remains active until the end of the paid cycle, with no further renewal.
• Price adjustments: prices may be adjusted upon prior notice; the change applies to the following cycle, never retroactively.
• Your data after termination: after the contract ends, your data remains available for export for the period stated in the Privacy Policy and is then deleted or anonymized.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Send spam, unauthorized bulk messages or communications that violate the policies of the channels used (e.g. WhatsApp).
• Process End Customer data without a legal basis or in breach of the LGPD.
• Reverse engineer, copy, modify or create derivative works of the Platform.
• Resell, sublicense or make access available to third parties outside your company without Wattiq’s authorization.
• Circumvent the technical limits of your Plan, exploit vulnerabilities or test the security of the Platform without prior written authorization.
• Use the Platform for illegal, fraudulent or defamatory content, or content that violates third-party rights.

Violating these rules authorizes the immediate suspension of your Account — with notice whenever possible — and, in serious or repeated cases, the termination of the contract, without prejudice to applicable legal measures.

The data you enter on the Platform — End Customer records, proposals, quotes, conversation histories — remains yours. You grant Wattiq only the license necessary to host, process and display that content for the sole purpose of providing the service.

Regarding the personal data of End Customers, you act as controller and Wattiq as processor under the LGPD: we process that data according to your instructions and as described in the Privacy Policy. It is your responsibility to ensure a legal basis for collecting and using that data.

You are responsible for the lawfulness, accuracy and quality of the content you enter on the Platform. Wattiq does not pre-screen User content.

The AI Agents perform tasks autonomously based on your settings and the available data — and, like all technology based on artificial intelligence, they may produce inaccurate, incomplete or outdated results.

• Proposals, system sizing and quotes generated by the Agents support your operation — review them before making commitments to End Customers.
• Content, campaigns and ads produced by the Agents are published in your name and subject to each platform’s rules — review them before they go live.
• Messages sent by the Agents on your behalf (e.g. on WhatsApp) are your responsibility — configure and supervise them appropriately.

The AI Agents do not provide engineering, accounting or legal advice. Technical and commercial decisions — and the contracts signed with your End Customers — remain your responsibility.

The Platform — including software, brand, visual identity, layout, texts and other elements — belongs to Wattiq or its licensors and is protected by intellectual property laws.

Subscribing to a Plan grants you a limited, non-exclusive, non-transferable and revocable license, valid for the term of the contract, exclusively to use the Platform in accordance with these Terms. No other license or assignment of rights is implied.

Suggestions and feedback sent to Wattiq may be used freely to improve the product, with no obligation of compensation or attribution.

We work to keep the Platform available and secure, with continuous monitoring and maintenance windows announced in advance whenever possible. Even so, no internet service is immune to failures, and we do not guarantee uninterrupted availability.

To the maximum extent permitted by law, Wattiq is not liable for indirect damages, loss of profits or loss of business arising from the use or unavailability of the Platform, nor for acts of third parties — such as messaging channel instability, decisions by advertising platforms or failures of infrastructure providers.

Where Wattiq is found liable, liability is limited to the amount you actually paid in the 12 (twelve) months preceding the event — except in cases where the law does not allow limitation.

Nothing in these Terms excludes rights that applicable law — including the Brazilian Consumer Protection Code, where it applies — guarantees you and that cannot be limited by contract.

We may update these Terms to reflect changes in the product, in legislation or in our practices. Material changes will be communicated at least 30 days in advance, by e-mail and/or a prominent notice on the Platform.

Continued use of the Platform after the changes take effect implies agreement with the new version. If you do not agree, you may terminate your Plan before they take effect, with no penalty arising from the change.

The current version, with its last-updated date, is always published on this page.

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the judicial district of Wattiq’s registered office are elected to settle disputes, except where consumer protection legislation guarantees the jurisdiction of your domicile.
